ICC Prosecutor Suspended Amid Misconduct Allegations

The chief prosecutor of the International Criminal Court (ICC), Karim Khan, has been temporarily suspended by the British Bar Standards Board. This decision follows a finding of “serious misconduct” by the executive committee of the ICC’s oversight body, the Bureau of the Assembly of States Parties.

Khan, a British barrister, was removed from his ICC duties after accusations emerged about his inappropriate relationship with a female staff member. The 56-year-old prosecutor has denied these allegations, stating he “unequivocally denies all allegations of impropriety.”

The Bar Standards Board, which regulates legal professionals in England and Wales, announced Khan’s suspension and mentioned that disciplinary proceedings are expected to occur within four weeks. They have not disclosed the basis of their decision.

The controversy surrounding Khan has been ongoing for over two years, including a separate investigation sanctioned by the Trump administration regarding his probe into Israeli officials. Khan’s suspension comes after a United Nations report suggested nonconsensual sexual contact with a female aide, though a three-judge panel found the investigation inconclusive.

The ICC’s Assembly of States Parties, a 125-member body, is set to vote on Khan’s permanent removal. A diplomatic source, speaking under anonymity, hinted that some countries believe the allegations aim to obstruct the court’s investigation into Israel. This follows the ICC’s issuance of arrest warrants for Israeli Prime Minister Benjamin Netanyahu and a former defense minister over alleged war crimes.

U.S. sanctions imposed during Donald Trump’s presidency have further complicated matters, affecting ICC investigations into American personnel in Afghanistan alongside the Israeli inquiries. These sanctions are reportedly impacting the court’s broader activities.

A special session is scheduled for July 24 in New York to decide Khan’s fate. Sixty-three votes are required to remove him, though his potential successor remains unknown. Two deputy prosecutors have been managing his responsibilities for the past year.
