Harvey Weinstein’s Conviction Upheld by Appeals Court; Resentencing Ordered

An appeals court in California has upheld the 2022 conviction of Harvey Weinstein for rape and sexual assault. However, the panel has mandated a resentencing due to the trial judge’s consideration of previously overturned New York convictions in the original sentencing.

The decision was rendered by a unanimous three-judge panel from California’s 2nd District Court of Appeal. “We reject his attempts to disturb the jury’s guilty verdicts,” the judges stated, confirming that Weinstein’s constitutional rights were not breached during the trial.

Juda Engelmayer, a spokesperson for Weinstein, expressed disappointment, stating in an email, “We are disappointed by today’s decision and respectfully disagree with the Court of Appeal’s conclusions regarding the fairness of Mr. Weinstein’s trial. At the same time, the court correctly recognized that his sentence cannot stand.”

Resentencing Required

The need for resentencing arose because the trial judge in California had considered Weinstein’s New York convictions, which were subsequently overturned, as an aggravating factor. This was acknowledged by California’s attorney general.

Meanwhile, Weinstein, aged 74, remains incarcerated in New York, where he is convicted of another sexual felony. He awaits sentencing in September, with prosecutors seeking a 20-year prison term.

Details of the California Conviction

In December 2022, Weinstein was convicted in California of raping and sexually assaulting an Italian model and actor, referred to as Jane Doe 1 during the trial. The victim has since identified herself as Evgeniya Chernyshova and filed a civil lawsuit against Weinstein.

Chernyshova testified that Weinstein assaulted her in her hotel room during the 2013 LA Italia Film Festival. The Associated Press, which typically does not name sexual abuse victims, has identified Chernyshova with her consent.

Defense Arguments and Court Rulings

Weinstein’s defense argued for a new trial, claiming that the trial judge improperly blocked questioning about Facebook messages between Chernyshova and festival head Pascal Vicedomini. The defense contended these messages could have suggested a sexual relationship, undermining Chernyshova’s testimony.

However, the appeals court found that Weinstein had the opportunity to make his arguments using other evidence, dismissing claims of a constitutional rights violation. Additionally, the defense’s attempt to introduce the messages was rejected for breaching California’s rape shield law, which protects an accuser’s sexual history.

Future Legal Proceedings

Despite the ruling, Weinstein’s legal team plans to seek further review. “This is not the end of the appellate process,” Engelmayer stated, indicating intentions to petition the California Supreme Court.

The Los Angeles County District Attorney’s Office refrained from commenting until further review of the decision, and Chernyshova’s attorney has not yet responded to requests for comments.
