Upon his return, Alito was present at the court the subsequent Monday, participating actively in a crucial case concerning mailed ballots. He continued to engage in all the court’s hearings over the following two weeks.

Alito, who recently celebrated his 76th birthday, is one of the oldest members of the Supreme Court, with only Justice Clarence Thomas being older at 77.

Alito had traveled to Philadelphia for a Federalist Society event that reviewed his two decades on the Supreme Court. He experienced discomfort during a dinner following a panel discussion. As a precaution, his security team advised him to seek medical advice before embarking on the drive back to Virginia. McCabe confirmed he received fluids for dehydration.

Although Alito has not publicly discussed any plans to retire, there is speculation regarding a potential retirement. If Alito retires soon, it would allow former President Donald Trump an opportunity to nominate a fourth justice, reinforcing the conservative majority on the bench.
