In a surprising turn of events, former Honduran President Juan Orlando Hernández, who was convicted last year for his involvement in a drug trafficking scheme that transported large quantities of cocaine to the United States, has been released from prison. This release follows a controversial pardon issued by former U.S. President Donald Trump, officials confirmed on Tuesday.

Hernández was freed from U.S. Penitentiary Hazelton in West Virginia on Monday, according to a spokesperson from the Federal Bureau of Prisons. The agency’s online records also confirmed his release.

The ex-president’s release coincides with the aftermath of Honduras’ presidential election. Trump, explaining his decision aboard Air Force One, stated that many in Honduras believed Hernández had been wrongfully accused, despite U.S. prosecutors’ claims that he facilitated the cocaine trade through the country.

Context of the Pardon

The pardon is part of Trump’s broader counter-narcotics strategy, which has sparked debate throughout Latin America. In recent months, U.S. forces have engaged in multiple operations targeting vessels suspected of smuggling drugs northward, actions that the Trump administration defends as necessary measures against drug cartels. Critics, however, argue these operations push the boundaries of international law.

Under Trump’s directive, 21 strikes have been executed on alleged drug-carrying boats, resulting in at least 83 fatalities. The administration equates its anti-cartel efforts with the war on terror, akin to the campaign against al-Qaida post-9/11.

Reactions from Hernández’s Family

Ana García, Hernández’s wife, expressed gratitude towards Trump for the pardon through social media platform X. In statements to the press, García paralleled her husband’s case to Trump’s legal battles, suggesting a politically motivated prosecution by U.S. authorities.

She recounted a call from Hernández, who informed her of his imminent release. He is currently at an undisclosed location for safety reasons but plans to address the public soon, according to his lawyer Renato Stabile.

The push for a presidential pardon began months ago, culminating in a letter from Hernández to Trump on October 28, his birthday. Trump announced the pardon shortly thereafter.

Criticism and Support

While Trump’s pardon has drawn ire from Democratic lawmakers, who criticized it as undermining efforts to combat drug trafficking, Hernández’s attorney expressed relief and appreciation for the decision.

Some U.S. politicians, including Senator Dick Durbin, have voiced strong opposition to the pardon, condemning Hernández’s previous actions as detrimental to the U.S.

Despite the pardon, Honduran authorities, led by Attorney General Johel Zelaya, have pledged to continue seeking justice against Hernández, hinting at possible legal proceedings in Honduras.

Background on Hernández’s Conviction

Hernández was apprehended in early 2022 at the behest of the United States, only weeks after Xiomara Castro assumed the Honduran presidency. He was later sentenced to 45 years in a New York court for accepting bribes from drug traffickers to facilitate the movement of cocaine through Honduras.

Despite maintaining his innocence, Hernández was deemed guilty by U.S. courts, with Judge P. Kevin Castel emphasizing the need for accountability among those in power.

Honduras’ political landscape is shifting, with the recent presidential elections potentially influenced by the timing of Hernández’s pardon. The pardon’s announcement has stirred discussion and speculation regarding its impact on the election outcome.
