The Wisconsin Elections Commission has referred complaints to the Brown County district attorney, alleging Musk promised $1 million to voters, possibly breaching the state’s election bribery laws.
These complaints, originating from Milwaukee and Green Bay voters, were submitted after Musk distributed checks at a rally shortly before the election. The bipartisan commission, which includes both Democrats and Republicans, voted 5-1 to advance the complaints to the district attorney’s office, as confirmed by commission spokesperson Emilee Miklas.

The district attorney now has 40 days to determine whether criminal charges should be pursued against Musk. The allegations state that Musk’s social media offer of $1 million to voters was intended to influence voting behavior in the Supreme Court election.

Despite this, Schimel lost to the Democratic-backed Susan Crawford by a significant margin. In addition to the election bribery complaints, Musk’s actions have led to a lawsuit from the Wisconsin Democracy Campaign. This lawsuit, filed in Brown County, seeks to bar Musk from offering financial incentives to voters in future elections, citing violations of voting bribery laws.
Attempts to legally prevent Musk from distributing the checks were unsuccessful, as the state courts ruled against the Democratic attorney general’s lawsuit. Musk’s legal team argues that the giveaways were an expression of free speech, aiming to galvanize opposition to “activist judges” rather than support specific candidates.
