Institutional Crisis Intensifies in Brazil’s Supreme Court
The Supreme Court of Brazil is facing heightened tensions as two of its prominent justices, Alexandre de Moraes and Andre Mendonca, are embroiled in a conflict that has led to calls for severe sanctions against each other.
Justice de Moraes, known for his role in the incarceration of former President Jair Bolsonaro following an attempted coup, is at the center of this controversy. Meanwhile, Justice Mendonca, the court’s first evangelical appointee by Bolsonaro, has been pushing for an investigation into de Moraes. The conflict is deeply rooted in an ongoing federal investigation into financial misconduct linked to Banco Master and its owner, Daniel Vorcaro, which has also implicated several politicians ahead of the upcoming elections.
Mendonca is reportedly advocating for de Moraes’s suspension amid accusations of graft, while de Moraes has countered with demands for Mendonca’s impeachment for unauthorized investigations. Both justices, who are seated adjacently in the Supreme Court due to their appointment chronology, have become central figures in this legal drama.
Recently, Mendonca disclosed intercepted messages from Vorcaro showing frequent communication with de Moraes. These messages have fueled suspicions, particularly after revelations that de Moraes’s wife provided legal services to Banco Master under a substantial contract. This led to mounting pressure from political figures, media, and legal experts for de Moraes to step down.
Messages from Vorcaro included pleas for intervention, such as, “I am grateful to you for my life,” and requests to “block all these evil (measures against Banco Master).” Even presidential candidate Flávio Bolsonaro, implicated in the scandal for receiving funds for a film about his father, urged de Moraes to resign.
Adding complexity to the situation, it was revealed that Mendonca had private meetings with Vorcaro, both last year and more recently, without the requisite court authorization or presence of federal agents. Mendonca justified these meetings by citing Vorcaro’s claims of police mistreatment, although Brazil’s attorney general dismissed these allegations.
In response, de Moraes petitioned the court’s Chief Justice Luiz Edson Fachin to scrutinize Mendonca’s actions, labeling them as politically motivated and suggesting they constitute an impeachable offense. While the Senate holds the power to impeach justices, numerous petitions against de Moraes and a few against Mendonca are pending.
Reports indicate that Mendonca has also requested Fachin to suspend de Moraes following recent disclosures. Fachin has called for explanations from Mendonca, de Moraes, Attorney General Paulo Gonet, and federal police director Andrei Rodrigues. During a ceremony, Fachin emphasized the importance of preserving institutional integrity amid rising tensions, stating he would act according to legal requirements.
As the justices refrained from interacting during recent court sessions, the next meeting is anticipated with interest as the crisis continues to unfold.
