Arizona Voters Approve Proposition to Expand Police Powers Over Immigration

In a significant move, Arizona voters have passed Proposition 314, a measure designed to expand the powers of state law enforcement concerning immigration. This proposition empowers police to arrest individuals suspected of entering the country unlawfully and permits state judges to order deportations.

Proposition 314 makes unauthorized border crossing a state felony, a much harsher classification compared to the federal level where it is generally treated as a misdemeanor. This change allows for more severe sentencing and aligns with the proposition’s broader goal of creating stricter enforcement mechanisms for immigration violations.

The measure also imposes more stringent requirements on businesses employing immigrants and grants immunity to law enforcement from civil lawsuits stemming from its enforcement. Additionally, harsher penalties are set for those convicted of selling fentanyl that results in death.

Despite its passage, the proposition does not allocate funding for its enforcement, which is estimated to cost Arizona taxpayers $325 million annually. The state’s prison system could also see an annual increase of $50 million in costs.

Voter Perception and Outreach Challenges

Notably, the proposition was placed on the ballot by Republican lawmakers, in collaboration with the Arizona Sheriff’s Association. It received substantial voter support, amassing over 1.54 million votes, making it more popular than many statewide candidates, though it did not surpass the Arizona Abortion Access Act in terms of approval.

However, community groups like Aliento, which supports undocumented Arizonans, reported that many voters were misinformed about the proposition’s implications. Aliento’s CEO, Reyna Montoya, noted that voters primarily associated the measure with fentanyl restrictions, not realizing its broader impact on immigration enforcement.

Montoya expressed concerns over the limited time available for voter education on the proposition’s implications, especially given the rapid legislative process it underwent before reaching the ballot.

Potential Legal and Political Implications

The proposition’s future remains uncertain as it coincides with President-elect Donald Trump’s mass deportation plans, which promise a significant increase in immigration enforcement. However, the border-crossing provisions cannot be implemented until a similar Texas law, Senate Bill 4, is in effect for 60 days. This Texas law is currently under legal challenge for conflicting with federal immigration laws.

In Arizona, the proposition is viewed as a strategic maneuver by the Republican-majority legislature to bypass the Democratic governor and appeal directly to voters. Immigrant rights organizations, including Aliento and Living United for Change in Arizona (LUCHA), have vowed to challenge the proposition in court, arguing it could lead to racial profiling and is unconstitutional.

LUCHA had previously attempted to block the proposition from appearing on the ballot through legal action, but the Arizona Supreme Court rejected their lawsuit.

Once certified, the new law could face lawsuits that might delay its implementation or even result in its nullification. The legal battle over Proposition 314 is expected to be contentious, with potential implications for state and federal immigration policies.
