California Court Disbars Trump Ally John Eastman

A California lawyer tied to former President Donald Trump’s post-2020 election efforts has been stripped of his legal credentials. The California Supreme Court ordered the disbarment of John Eastman, marking the end of a prolonged initiative by the state bar to revoke his license following his development of a controversial legal strategy regarding election certification.

In 2024, the State Bar Court of California judge had previously recommended Eastman’s disbarment, asserting his strategy was aimed at convincing then-Vice President Mike Pence to disrupt the certification of President Joe Biden’s electoral victory. Eastman maintained that his actions were merely advisory in nature.

George Cardona, the chief trial counsel for California’s State Bar, highlighted that Eastman’s actions involved advancing unfounded claims about the 2020 election to mislead various parties. Cardona commented, “The Court’s order underscores that Mr. Eastman’s misconduct was incompatible with the standards of integrity required of every California attorney.”

Eastman’s legal representative, Randall Miller, expressed concerns over the ruling, indicating plans to appeal to the U.S. Supreme Court. Miller argued that the decision conflicts with established U.S. Supreme Court precedents concerning First Amendment protections, especially in matters of attorney discipline.

The States United Democracy Center, which initiated an ethics complaint against Eastman, supported the court’s decision. Christine P. Sun, a senior vice president at the nonprofit, stated, “His unethical actions have had real, lasting consequences for our democracy.”

Eastman, a trusted advisor to Trump prior to the January 6, 2021, Capitol event, crafted a memo proposing that Pence should reject legitimate electoral votes for Biden during the Congressional session to maintain Trump’s presidency.

Efforts to revoke Eastman’s law license painted him as fabricating a baseless theory and spreading false fraud claims to overturn the election outcomes. Conversely, Eastman’s defense claimed he sought only to delay the vote count for further investigations into alleged electoral discrepancies. Numerous courts, including those with judges appointed by Trump, dismissed these fraud allegations.

Besides these proceedings, Eastman has faced criminal charges in Georgia related to accusations of conspiracy to reverse Trump’s loss in the state. This case was dismissed in November. Earlier, Eastman was among those pardoned by Trump for alleged involvement in overturning the 2020 election results, though the pardon only covered federal offenses.

Eastman’s professional history includes clerking for U.S. Supreme Court Justice Clarence Thomas and serving as the dean of Chapman University law school in Southern California from 2007 to 2010. He retired from the university in 2021 after a faculty letter signed by over 160 members urged the institution to take action against him.

The California State Bar remains the sole U.S. court system dedicated to attorney discipline and regulation.
